These Terms & Conditions apply to purchases made through ConcreteCountertopSupply.com and products and services supplied by Fishstone. By placing an order, the purchaser agrees to these Terms & Conditions.

Ordering & Payment

We use commercially reasonable administrative, technical, and payment-processing safeguards designed to protect customer and payment information. Payment information is processed through our payment service providers. However, no internet transmission or electronic storage system can be guaranteed to be completely secure.

For fraud-prevention purposes, first-time customers may be required to use the same billing and shipping address on credit-card orders. Orders with differing billing and shipping addresses may be placed on hold until additional verification is completed.

We reserve the right to request additional information necessary to verify an order, payment method, billing information, shipping destination, or identity of the purchaser before shipment.

Customers may also contact us regarding alternative payment arrangements. Orders paid by check will not ship until funds have cleared.

Order Acceptance

Receipt of an order confirmation does not constitute final acceptance of an order.

Sales Tax

Applicable sales tax will be calculated and collected when required by law.

Customers claiming tax-exempt status are responsible for providing valid and current exemption documentation before the applicable transaction is completed.

Shipping & Delivery

Shipping charges are generally based on product size, weight, shipping method, delivery destination, and other carrier requirements.

The shipping amount displayed during checkout applies to the shipping method selected and information provided by the customer. Additional charges may apply in circumstances including, but not limited to, incorrect addresses, address corrections, residential or limited-access freight delivery, liftgate service, re-delivery, storage charges, special handling, or other carrier-imposed fees.

Customers are responsible for providing a complete and accurate shipping address.

Shipping and delivery dates are estimates unless expressly stated otherwise. ConcreteCountertopSupply.com does not guarantee carrier transit times.

We are not responsible for delivery delays caused by carriers, severe weather, transportation interruptions, labor disruptions, government actions, natural disasters, supplier interruptions, or other circumstances outside our reasonable control.

International orders and shipments to locations outside our standard service area may require separate shipping arrangements and quotations.

Parcel Shipping Damage & Order Discrepancies

Customers should inspect packages promptly after delivery.

Shipping damage, shortages, incorrect merchandise, or other order discrepancies should be reported to ConcreteCountertopSupply.com as soon as reasonably possible after delivery.

Customers should retain damaged products, packaging, shipping cartons, labels, and related materials until the matter has been resolved.

Photographs may be required to document damage or assist with a carrier claim.

LTL & Freight Shipments

Freight shipments must be inspected carefully before the delivery receipt is signed.

If a pallet, container, packaging, or merchandise shows visible evidence of damage, the customer should clearly describe the damage on the carrier's delivery receipt before accepting the shipment.

Writing only "subject to inspection" does not constitute documentation of freight damage.

Photographs of damaged pallets, packaging, and merchandise should be taken whenever possible.

If damage is severe, the customer may refuse the damaged shipment.

Concealed freight damage discovered after delivery should be reported promptly to both the carrier and ConcreteCountertopSupply.com. All packaging, pallets, and damaged merchandise should be retained until the freight claim is resolved.

Failure to inspect a freight shipment or properly document visible damage with the carrier may limit or prevent recovery under a freight claim.

Risk of Loss

Unless otherwise agreed in writing, risk of loss passes in accordance with the shipping terms applicable to the order and applicable law.

Once merchandise has been transferred to a carrier, ConcreteCountertopSupply.com will reasonably assist customers with eligible carrier claims but cannot guarantee approval or payment of a claim by the carrier.

Returns

Eligible products may be returned within 30 days of receipt, subject to the requirements below.

Approved returns are subject to a 20% restocking fee unless otherwise agreed in writing or prohibited by applicable law.

Original shipping charges are non-refundable.

Return Goods Authorization

Before returning merchandise, customers must obtain a Return Goods Authorization (RGA).

Returns received without authorization may be refused and may not receive credit.

Customers should use a shipping service that provides tracking and should retain proof of shipment.

ConcreteCountertopSupply.com is not responsible for returned merchandise that is lost or damaged while being shipped back to us.

Where permitted by law, canceled orders may be subject to reasonable non-refundable payment-processing, special-order, handling, or other costs already incurred by ConcreteCountertopSupply.com.

Product Use, Suitability & User Responsibility

Many products sold by ConcreteCountertopSupply.com are professional, industrial, construction, concrete, coating, chemical, or specialty materials whose performance depends heavily upon conditions outside our control.

ConcreteCountertopSupply.com and Fishstone may provide technical information through product pages, technical data sheets, emails, telephone conversations, videos, articles, social media, training, calculators, mix recipes, dosage recommendations, coverage estimates, or other communications.

This information is provided as general guidance based upon information and experience believed to be reliable at the time it is provided. Actual results may vary.

Color, Finish & Appearance

Concrete and cement-based products contain natural and manufactured raw materials that may vary between lots or batches.

Finished color, shade, texture, sheen, surface appearance, air content, pinholing, and other visual characteristics may vary based upon raw materials, water content, mixing, curing, temperature, application technique, substrate, mold materials, sealing, environmental conditions, and other factors outside our control.

Storage, Shelf Life & Product Condition

Customers are responsible for storing products according to manufacturer recommendations, technical data sheets, product labeling, and reasonable industry practices.

Products may be damaged or degraded by exposure to moisture, freezing temperatures, excessive heat, contamination, prolonged storage, or improper handling.

Shelf-life information generally assumes unopened products stored under recommended conditions.

We do not warrant products that have been improperly stored, contaminated, altered, diluted, frozen, overheated, or otherwise handled contrary to product instructions.

Temperature-Sensitive Products

Certain products, including some sealers, polymers, coatings, admixtures, and related materials, may be sensitive to freezing or extreme temperatures.

Products identified as "DO NOT FREEZE" or otherwise temperature-sensitive should be shipped using a service appropriate for anticipated weather conditions.

If a customer chooses a shipping method that exposes temperature-sensitive material to an unreasonable risk of freezing or other temperature-related damage, the customer assumes that shipping risk to the fullest extent permitted by law.

ConcreteCountertopSupply.com cannot guarantee the temperature conditions encountered while a shipment is in the possession of a third-party carrier.

Safety Data & Product Handling

Customers are responsible for reading and following all product labels, technical data sheets, Safety Data Sheets (SDS), instructions, warnings, personal protective equipment requirements, and applicable regulations before using or handling products.

Purchasers are responsible for ensuring that employees, contractors, customers, and other persons who may use or encounter the product receive appropriate safety information and training.

Products must be used only for lawful and appropriate purposes.

Product Warranties

ConcreteCountertopSupply.com sells products manufactured by Fishstone as well as products supplied by other manufacturers.

Third-party products may be covered by warranties provided by their respective manufacturers. Manufacturer warranty terms, exclusions, procedures, and limitations apply to those products.

Except for warranties expressly provided in writing by ConcreteCountertopSupply.com, Fishstone, or the applicable manufacturer, products are provided without additional warranties to the fullest extent permitted by applicable law.

To the fullest extent permitted by law, we disclaim implied warranties, including implied warranties of merchantability and fitness for a particular purpose, where such warranties may lawfully be disclaimed.

Nothing in these Terms & Conditions excludes warranties or rights that cannot legally be excluded or limited.

Limitation of Liability

To the fullest extent permitted by applicable law, ConcreteCountertopSupply.com, Fishstone, their owners, employees, representatives, and affiliates shall not be liable for indirect, incidental, special, consequential, exemplary, or economic damages resulting from the purchase, use, misuse, inability to use, failure, or performance of a product.

If Fishstone cancels a class, registered attendees may elect to receive a refund of the applicable class payment or apply the payment toward another available class.

Unless otherwise stated for a specific event:

Participants are responsible for their own travel, lodging, transportation, meals, and other related expenses unless expressly stated otherwise.

Fishstone is not responsible for travel or lodging expenses resulting from a class cancellation or rescheduling.
